CNN.com - Bush: 'No doubt' NSA surveillance is legal - Jan 26, 2006: "Bush told a White House news conference that the domestic spying program 'is designed to protect civil liberties' and declared that 'it's necessary.'"

My guess is he didn't refer to it as (the) "domestic spying program."
